According to eIDAS regulation that entered into force on the 1st of July 2016, e-signatures are divided into advanced and qualified. Both types of signatures must meet the requirements of the regulation. A qualified electronic signature is essentially an advanced signature, but it is created using a qualified electronic signature creation device and is certified by a qualified e-signature certificate. Qualified e-signature has the same legal effect as a handwritten signature and is recognized in all EU Member States. Advanced e-signature attested by a qualified certificate is considered strong evidence in court. Similarly, according to the eIDAS regulation it is forbidden to refuse to recognise the legal value of an electronic signature and its admissibility as evidence in legal proceedings simply because it is electronic or does not meet the requirements for qualified electronic signatures.
